Compliance Certificates

A compliance certificate is written confirmation from the City of Camrose that development on a property meets the regulations of the Land Use Bylaw. The City does not require people to get compliance certificates, but it will issue them when asked to do so.

Compliance certificates are increasingly being called for when real estate is sold. Lending institutions require them before they will approve mortgages. Lawyers representing home buyers may demand clients' investments. Also, standard residential real estate purchase contracts often require the vendor to guarantee that land use regulations do not encroach upon easements, utility right-of-ways or adjacent lands.

Applying for a Compliance Certificate

A compliance certificate request must be made in writing to the Planning and Development Department. The request must include:

  • Two (2) copies of the real Property Report (prepared by an Alberta Land Surveyor) indicating the municipal and legal address.
  • The owner's name.
  • The applicant's name, address, and phone number (if they want to be called when the certificate is issued).
  • The non-refundable application fee.

Note: Fees are applied to both letters of compliance and letters of non-compliance.

The Review Process

The Development Officer studies the real property report to ensure it meets the regulations outlined in the City of Camrose Land Use Bylaw #2567/07. If all the regulations are met, the two copies of the real property report will stamped with a Compliance Certification and signed by a Development Officer certifying the property conforms to the Land Use Bylaw. One copy will be sent back to the applicant, and the other copy of the real property report will be filed in the property file.

If the building is non-conforming a letter of non-conformance will be issued stating the reasons for non-compliance.

There are several ways to deal with a non-conforming building:

  • A letter of no action may be issued.
  • An encroachment agreement may be required. (fees apply)
  • A Special Development Allowance may be granted. (Development fees apply)
  • Application may be forwarded to the Development Appeal Board. (fees apply)

If none of these options resolve the problem, the non-conforming structure(s) may need to be removed.

When the non-compliance is rectified you will need to reapply for a compliance certificate.

Processing Time

Processing times vary, depending on the number of certificates being requested. A minimum of five (5) working days should be allowed for a compliance application to be reviewed, unless rush service has been requested.

If there is a problem with compliance it may take a long time to resolve. Applying for a compliance certificate as soon as you decide to sell a property can save you from costly delays.
